At Forfar the seventeenth day of September, Eighteen

hundred and eighty nine years, in presence of John

Fyfe Craik, Esquire, One of Her Majesty’s Justices

of the Peace for the County of Forfar, Appeared Robert

Bruce, Agent of the Commercial bank of Scotland Limited

at Forfar, one of the Executors of the deceased Wil

liam Edward, Surgeon at Letham, who being solemnly

sworn and examined deponed that the said William

Edward died at Letham in the County of Forfar domi

ciled there, upon the sixth day of August, Eighteen

hundred and eighty nine; That the said William Ed

ward was never married, That the deponent has

entered upon the possession and management of the de

ceased’s Estate as Executor nominated by him, along

with John Ogilvy, Station Master of the Caledonian

Railway Company at Blantyre; Jessie Ogilvy or Fyfe wife

of and residing with Alexander Fyfe, Mason, Letham; and

Jane Edward, sister of the deceased, residing at Letham

in a Settlement executed by him upon the thirteenth day

of September, Eighteen hundred and eighty eight reg

istered in the Sheriff Court Books of the County of For

far on the twelfth day August Eighteen hundred and

eighty nine an extract whereof is now exhibited and

signed by the Deponent and the said John Fyfe Craik

as relative hereto; That the Deponent does not know

of any Testamentary settlement or writing relative

to the disposal of the deceased’s personal estate or

effects or any part thereof, other than the said

Settlement dated and registered as aforesaid; That the

foregone Inventory signed by the Deponent and the

said John Fyfe Craik as relative hereto is a full

and complete inventory of the personal estate and ef

fects of the said deceased William Edward wheresoever

situated and belonging or due to him beneficially at

the time of his death in so far as the same has

come to the Deponent’s knowledge; That the Deponent does

not know of any money or property belonging to the de

ceased secured by Scottish Bonds or other instruments

excluding Executors. That the said deceased had no

heritable estate in this country in so far as known

to the Deponent; That the said deceased William Ed

ward was due and owing at the time of his death

to persons resident in the United Kingdom the debts

enumerated in the foregoing scheduled; That these

debts are payable by law out of the estate and

effects comprised in the foregoing Inventory are

not nor any of them voluntary debts made payable

on the death of the deceased or voluntary debts

payable under some instrument delivered to the

douce? thereof within three months before the death

of the deceased or debts which are primarily payable

out of any real estate belonging to the deceased,

or debts in respect whereof a reimbursement is

capable of being reclaimed from any real estate of

the deceased or from any other estate or person

whatsoever; That these debts with the funeral ex

penses of the said deceased as also shown in the

said schedule amount to Fifty eight pounds eleven

shillings and sixpence; That the nett value at the

date of the said personal estate and effects situ

ated in Scotland including the proceeds accrued

thereon down to this date and after deducting

the amount of the said debts and funeral expenses

is eight thousand two hundred and ninety six

pounds sterling and does not exceed eight thousand

three hundred pounds; That Confirmation of the said

personal estate is required in favour of the Deponent

and the said John Ogilvy, Jessie Ogilvy or Fyfe and

Jane Edward; All which issue ? the Deponent

At Forfar the twelfth day of August One thousand eight

hundred and eighty nine years, the Deed hereinafter

engrossed was presented for registration in the Sher

iff Court Books of the County of Forfar for preserva

tion as a Probonio Writ, and is registered in the

said Books as follows:-

This is the will of William Edward, Surgeon

1    Charles Smith Edward my Brothers James son is to get

      nothing, nor to be allowed to enter my house; that’s him settled

2    John Young my sister Anns son is to get Five pounds

      William Young Five pounds, Jane Young their sister

      Five pounds

3    John Ogilvy Station Master upon the Caledonian Rail

      way Twenty pounds, Jessie Ogilvy thirty pounds yearly

      to help to bring her family up and educate them

      and also money to College her three sons and John

      Ogilvy money to College one son the amount each

      year not to exceed thirty pounds for each of them

      It has taken me hard work fifty years to make the

      money that I have and I want it kept for another

      fifty years and what is over expenses paying each

      year added twice a year to the stock. The estate at

      present is as follows:-

      three Thousand four hundred pounds in the Royal

      Bank at Forfar, Two thousand in the Bank of Scotland

      at Forfar.

      Two Thousand six hundred pounds in the Commercial

      Bank at Forfar all upon Deposit Ricipt, Besides my

      Bank Account, pony and furniture.

      I appoint Robert Bruce, Agent in the Commercial Bank

      at Forfar and John Ogilvy, Station Master and Jessie

      Ogilvy his sister and Jane Edward my sister my

      Trustees, The Trustees always to be 4 Haldane Edward

Fyfe if he comes up well to be appointed one at

21 years, Everything here is my own and if any

person enter objections beat them off (Signed) William

After the fifty years is past the money to Purchase   

an Estate in my name that cannot be sold nor

indebted and the income from it after paying expenses

to be divided amongst those mentioned in my will

yearly (Signed) William Edward, Surgeon, Letham

10th August 1889. We hereby accept the office of Trustees

conferred on us under the foregoing Settlement (Signed)
